We've Been Using The Wrong Science In Court For 50 years

Bloodstain pattern analysis, founded by Herbert Leon MacDonell's 1971 basement study, was widely adopted without rigorous validation. The technique failed to account for gravity and drag in trajectory calculations, leading to incorrect victim positioning reconstructions. The first baseline reliability study wasn't conducted until 2014—over 50 years after court adoption. A 2021 study found analysts disagree on stain interpretation 8% of the time, and the same stain can result from multiple different mechanisms.
Fingerprint analysis, despite being considered highly accurate and used in phones and passports, suffered a high-profile failure in the 2004 Madrid train bombing case. Brandon Mayfield, an Oregon lawyer with no passport, was incarcerated based on a fingerprint match to a detonator bag. The problem stems from how minutiae (ridge splits and endings) are identified subjectively—different examiners see different numbers of minutiae in the same print. Studies show that even the same examiner reaches different conclusions 10% of the time when examining the same prints twice. Conformity bias compounds this issue when multiple experts review the same evidence sequentially.
DNA analysis, while powerful, faces significant challenges with trace DNA and DNA mixtures. Modern sensitivity allows identification from 0.4 nanograms of DNA, but this can lead to false incriminations when DNA is transferred through contamination—as happened with Lucas Anderson, a homeless man charged with murder after paramedics accidentally transferred his DNA to a murder victim. DNA mixtures from multiple individuals are the most common source of error in DNA interpretation. A 2013 National Institute of Standards and Technology study found that 69% of labs incorrectly analyzed a deliberately complex four-person DNA mixture, with only 21% deeming it inconclusive. No lower limits exist for DNA sample quality, and labs decide themselves when samples are too mixed to analyze.
